Hindu Muslim Court Marriage in Delhi without notice

India is a secular country and in this secular country, plenty of people who belong to a different religion are living. Every religion has its own culture, traditions, and rituals which are getting followed at every event and festival. People prefer to complete the marriage of the children in the same rituals and in the same religion. This becomes the tradition but what if anyone wants to get married to someone else who does not belong to the same religion ?

Well, the religious approach may not support this but the constitutional approach does. If 2 parties are willing to get married and they have eligibility to complete the marriage then the court will allow them to get married under any condition. The couple will just have to show the eligibility and other references which are required for completing the marriage and hence the court allows them to get married without any interruption. If they face any religious interruption or threat then the court will also take action against that party. In the eyes of the constitution, if 2 parties are eligible to complete the marriage and willing to complete the marriage with the specified party then the court won't stop them or even protect them in specified cases.

The first and the most important eligibility criteria are the fulfillment of the required age. The couple will have to ensure that they're completely eligible with the minimum age of marriage set by the government. The government of India has set up the minimum age of marriage for boys which is not less than 21 years and for girls, the government set the minimum age of 18 years. Under the Special Marriage act, 1954

If the couple has to complete their Hindu Muslim court marriage in Delhi under the special marriage act, 1954 then they have to go through with the procedure which is listed below:-

Firstly, the couple will have to hire a court marriage associate and complete their counseling. After completing the counseling and hiring a lawyer for you, you have to visit the court.

In court, you have to get the application form. The application is available in the court. Well, there's also an option in which you can download it from the official website of the district court but we recommend you to visit the court and get the form.

Fill out the application form with the details of both parties and make sure that all the details which you enter are written correctly and should be verified. You also have to ensure that the application form must have the signatures of both parties with dedicated photographs.

Now, collect all the documents [if you don't know what are the documents required for court marriage then see the section below where we have discussed all the documents] and submit all the documents with the application form.

Visit the court on the appointed date and meet with the marriage registrar. The marriage registrar will get your application and check all the documents which you submitted to the court. After completing the identification of the documents the marriage registrar announces a 30-day waiting period.

Note :  The 30 days waiting period is recognized with the same "Objection period", Under this time interval the court will send the dedicated notice to your home and call for objection. Anyone can object to your marriage in 30 days and if the reason proves valid then the marriage registrar will cancel your application.

After the completion of 30 days, the couple will have to revisit the court and complete the final formalities in court.

When they visit the court, the marriage registrar will again verify all the documents and complete some final formalities.

Lastly, if no objection occurs the marriage registrar announces the completion of marriage and a dedicated marriage certificate will get issued to the couple.

Hence, the marriage of Hindu Muslim court marriage in Delhi will get completed. People may also submit their conversion certificate in which they prove that one of the parties changed its religion. Well, this is not mandatory so, you may skip it because under the special marriage act, 1954 there is no provision for the availability of conversion certification in Hindu Muslim court marriage in Delhi.

So, here we have discussed how the couple completes their marriage under the special marriage act, 1954 but there is another way by which the parties can complete their marriage which is the Hindu marriage act, 1954.

Under the Hindu Marriage act, 1955

Hindu marriage act, 1955 is for the party who belongs to the Hindu religion so that they can complete their marriage by following all the traditions which are followed under the rituals performed under the Hindu religion. Well, if one of the parties belongs to the Hindu religion then also both parties can apply for their morris under the Hindu marriage act, 1955. So, let's see the procedure by which 2 parties can easily perform their Hindu Muslim court marriage in Delhi.

Firstly, the couple will have to hire a court marriage lawyer and get the application form from the court. After getting the form they have to fill the form and before filling the form the parties will have to complete a procedure which is called a conversion.

Note For completing the conversion process the Muslim party whether he is a boy or a girl will have to visit the mandir and complete a procedure named Shuddhi. After completing the procedure of shuddhi the conversion of the religion will be completed. Now, the Muslim party also become a Hindu participant.

After filling out the form both parties should ensure that they have all the documents which are asked for by the government.

Visit the court for the first time and meet with the marriage registrar. The marriage registrar will complete all the verification purposes and check the originality of all the documents. After verifying all the documents the marriage registrar will announce the 30 days name as " The Objection period". It is a 30 days period where everyone has the right to oppose your court marriage application. If the reason for objection becomes genuine then the marriage registrar may cancel your marriage application.

Note The court will send the dedicated notice to the family members of both parties and call for the objections.

After the completion of the objection period, the marriage registrar will ask you to complete your marriage. You have to visit the Arya Samaj mandir and complete your marriage in traditional Hinduism. After completing your marriage, you have to visit the court and meet with the marriage registrar.

The marriage registrar will again verify all the documents and verify all the photos which you took during your marriage. After verification, the marriage registrar will complete the announcement of the completion of the marriage.

The couple will get their dedicated marriage certificate shortly from the court and they become eligible for applying for marriage registration in Delhi.

Note Arya samaj mandir is a government-authorized mandir that is recognized by the government for completing the Aryan samaj marriage. Under this mandir, you have to bring Mangal sutra, Sweet, Dakshina, Varmala, and many other things at the time of marriage.

In this way, the Hindu-Muslim couple can easily complete their Hindu-Muslim court marriage in Delhi. Well, this process only works when both parties are converting to the Hindu religion but what if both the party turns to the Muslim religion? Well, if this happens then they're not eligible to complete their marriage as per the rules and regulations of the Hindu Marriage act, 1955. They have to complete their marriage under the Special marriage act, 1954 provision or via Nikah Provision. So, let's see what is the procedure for competing in the Hindu Muslim court marriage as per the Nikah Provision.

Hindu Muslim Court Marriage in Delhi under Nikah Provision

If both parties turn to the Muslim religion then they don't have the allowance to complete their marriage under the Hindu marriage act, of 1954. They have only 2 options whether they complete their marriage under the special marriage act, 1954 provision [The dedicated procedure of Hindu Muslim marriage in Delhi under the special marriage act, 1954 is discussed above] or they have to go for the Nikah provision. So, let's see the procedure that the couple will have to follow for completing the court marriage under the Nikah provision.

After completing the nikah wait for 30 days and after completion of 30 days which is recognized with the name of the objection period gets over then. Revisit the court and get your application form.

The marriage registrar will verify your application and complete some final formalities. After completing the final formalities the marriage registrar will issue the dedicated marriage certificate and after getting the marriage certificate the couple becomes eligible for completing their marriage registration in Delhi.

Note The 30 days objection is also applied under this type of marriage between Hindu-Muslim parties. The court will ask for objections and if someone objects to your marrow with a valid reason then the marriage application becomes canceled by the court and if any illegal offense is made then the guilty party will face the consequences.

Hence the marriage gets completed and the court also issues the dedicated marriage certificate to the couple. After getting the marriage certificate from the court the couple will also get eligible to complete the application for marriage registration.
